Law Regarding R/C Cars In Public Places

Persoanlly speaking i can only say that using RC cars is roughly the same as using mini-moto's in public/private places.

Wrong, minimotos aren't legally allowed to be used unless they're on private land with the owners permission.

I get the odd complaint when using it on my road (I live on a quiet, in terms of useage, cul de sac) (T-Maxx is fairly quiet though, plastic exhaust ftw) so i just go to the field at the bottom of my road... No complaints so far down there. But yeah, as far as i know there's nothing stopping you from using it on a field or similar (don't use it on the roads obviously) with some respect and thought for others.

ive just had some lectures about noise as a public nuisance; unless your rc car is causing immediate damage to another person or their property, the only action they can take is to ask the local authority to issue a 'abatement notice'. This is can only be issued if its regular noise (each week) and if the local authority catches you doing it.

in the case an abatement notice is served upon you, you have 10 mins to stop, or the council rapes you for lots of money (you get fined)

we were at the school once and the police heard my mates marder so turned up with 2 squad cars, 2 bikes and more on foot lol. they just watched for a few mins asked some questions and left lol.

There are a few schools in my local area. All have decent sizes playgrounds, some have even bigger football pitches and playing fields.

Ideal for a spot of RC driving on an evening - that is if they didn't all have great big fences round them with spiky tops!!

School playgrounds used to be open, me and my mates used to go and play football in one of the local school playgrounds on an evening. Now they look more like prison exercise yards!

I guess thats the price of vandalism and the fear of roaming nonces!

you will always get moaners, it is polite to stop if a dog chases, i had it at the weekend i was at thornes park in wakefield (a few members will know where i mean) its a bloody big park and in the summer ya get loads of rc,s cars/boats/planes , i had a dog chase so i run it back to me and stopped, the dog followed and i gave it a rub lol, then the owner came over and we had a good chat about the cars etc etc, as for noise nitro cars dont make much more than a strimmer/lawnmower, and them things wake me up on a sunday morning but i dont go out rantting. at the end of the day you will always get some silly old fart who has not had a life and has moaned all there life. let them moan, let them ring the coppers as there nowt they can do

I have the same problem as well mate

To the point i dont run nitro no way near as much

I've been threatened with the police and them tlking to my parents.... tisk

anyway

The police cant really do much except tell u to move on

Anyway

Regarding the field

A council field - u are allowed

The dog owner is at fault for NOT keeping the dog undercontrol

keep running and if they police do happen to turn up then they will give u a chance to move on - dont push ur luck just go

Police should have better things to do.

Tbh its a Minor problem

They have more important tasks like the mass paper work they have to keep filling out

or responding to more important things like a pub brawl

They aint gonna do anything unless they are all in the station eating donuts with coffee

i have never had someone moan at me. once the exhaust fell off my firestorm, and one of the neighbours came out to have a look, but went back inside when they ealised it was just me... and thats about the most thats happened. one day somethign will happen, but not for a while. i used to run my car in my street (quiet cul-de-sac on the edge of town) but now i drive it on the common 100 meters away. a few little jumps and a nice dustbowl bit (where the chavs do donuts in their corsas and novas on friday night. fine by me, it keeps the amount of grass down :D)

It's not the vandals that are to blame though, it's all thanks to the kiddy fiddling perverts & paedo's. I did some work a few years ago fitting a sound-system in a school. I had to walk around with this great big badge on my shirt saying "VISITOR", i had a visitor pass dangling round my neck & every time i had to go back to the van for tools or equipment i had to have an escort & teachers had to unlock numerous wrought iron gates & cages, as you say it's more like prison - i bet prison visitors don't have to go through as much security.

Its worth noting that tresspass laws in scotland are different. You cannot be tresspassing unless the owner of the property has asked you to leave so you can bash on private property all you want but once the owner has asked you to leave and you DONT, then you are then tresspassing.

isn't that what i said :boredlook:

Well if you meant they're illegal to use on anything except private land with the owners permission you'd also be wrong, as far as we know there's no law prohibiting their usage. (Contrary to minimotos, where there ARE actually laws against them, and they're very strict)

sorry to be a boring git on this thread but:

if you are running an rc car in a public place are not supposed to have public liability insurance "in case" you run into someone and damage them?

Appreciate this case is an a field miles from anywhere so it is a bit extreme citing this but I am sure I have read something about this somewhere. I know for bashing none of us bother, just go out and run cos you are looking at a very small likelihood. I know I certainly dont!!

The BRCA give you it as part of your membership I think and when you pay your rc club sub's, which includes your BRCA, you come under their insurance policy with the BRCA. Although that only covers you for when you are running with the club.

Please feel free to correct me if I am wrong here...cos i usually am. :)

I had a annoying experince a few years ago when running my then new electric Rustler in the battered park tennis court near my house, some guy and his dog walked into the court so I stopped the car for fear of the dog chasing it, then he and the dog hung around the court for half a hour then buggered off... most puzzling. <_<

Well if you meant they're illegal to use on anything except private land with the owners permission you'd also be wrong, as far as we know there's no law prohibiting their usage. (Contrary to minimotos, where there ARE actually laws against them, and they're very strict)

My meaning was that they are classed as motorised vehicles not intended for use on the public highway. Same as go-peds & unregistered vehicles generally. Yes you can use mini-moto's on private land with the owners permission of course in exactly the same way as if you just turn up on someone's land & started thrashing your RC car around or anything else with an engine/motor & wheels fitted. Even if you are just chucking a ball about in some farmer's field & not on a designated public footpath, strictly speakng you need permission from whoever owns the field & they have every right to turf you off or have you done for trespassing if they catch you.

The mini-moto laws are no different, but as you say they have been made more strict & are enforced more, the underlying law is the same but the penalties are different. Get your collar felt with a mini-moto on someone's land without permission & it's highly likely you are looking at a day in court due to "zero tollerence" & peer pressure from the NIMBY's, But get your collar felt with an RC & you will simply be told to hoppit.. that is unless there are serious doubts about the copper's parentage.

BRCA includes public liability insurance. Costs £14 if your not affiliated with a club or £12 if you are...

Doesn't that just cover you for the network of BRCA clubs though? In other words you are insured so long as you are at a club scheduled event or trackday & have paid your entry fee. Can't see it extending over to bashing on some farmland or in a town park on some empty space.

I was quite happily driving my T-Maxx 2.5 in a field today, thought it was bloody nice because I had a day off work and the field was absolutely empty.

Eventually someone comes along with a dog and the dog decides to go full sprint after the car. I put the brakes on and bring the car to a stop realising the chances of it doing much damage to the car are slim, and the dog calms down and goes back to his owner.

UK Laws are now just too complicated!

However I think you did the right thing in bringing the car to a stop. Dogs and R/C cars do not mix!

My two Borzois would have chased the car, caught it and eaten the tyres! Been there - have had to replace tyres!

What would you have done if this had been the case? Called the cops to complain that the dog had wrecked your car?

In my opinion the dog owner had no rights to complain about you using your car in the field - likewise you would have had no rights if the dog had destroyed your car - if you had continued to drive it!

It's called common sense - which seems to be completely lacking in the UK today!

I may be completely wrong here in terms of UK Law,

There are some amount of " barristers, lawyers & solicitors" using this site :lol::lol::lol: I can't comment on the trespass issue or the legality of RC usage cause i don't know or don't pretend to either :ph34r:
